About the Project
The Eglinton Crosstown West Extension will bring the Eglinton Crosstown LRT another 9.2 kilometers farther west, creating a continuous rapid transit line from the east end of Toronto into Mississauga. The Stations, Rail, and Systems (SRS) package encompasses the design, construction, integration, and commissioning of key project components.
Position Overview
TRP has a current opening for a Project Legal Counsel to join our dedicated project legal team. In this role, you will support the delivery of the Metrolinx Eglinton Crosstown West Extension (ECWE) – Stations, Rail, and Systems (SRS) package. You will safeguard the general contractor’s commercial interests, manage complex interface risks, and ensure contractual compliance across this multi-billion dollar transit expansion.
Key Responsibilities
- Contract Administration
- Familiarization and advice on prime project agreements signed with Metrolinx to evaluate risk exposure.
- Being a point of contact for various subgroups on legal matters affecting the project.
- Providing advice regarding the Ontario Construction Act.
- Conducting legal research, drafting memoranda, drafting internal briefings and reports.
- Manage interface risks arising from interactions with separate civil, tunneling, and utility contractors.
- Draft specialized subcontracts and procurement orders that mirror the prime contract’s liabilities.
- Advising the contract and subcontract management team in respect of the administration of contracts being performed (including professional services agreements, supply agreements and construction subcontracts).
- Claims & Dispute Management
- Drafting and reviewing correspondence between the project team and project owner in collaboration with the commercial, construction and contract management teams.
- Supporting the management of subcontractor claims, litigation and other dispute resolution proceedings.
- Assess change orders and delay claims submitted by subcontractors.
- Prepare delay notifications and variation requests to submit directly to Metrolinx.
- Manage prompt payment mechanics in strict compliance with the Ontario Construction Act.
- Coordinate construction adjudications and assemble evidence for active dispute files.
- Regulatory & Corporate Compliance
- Communicating and coordinating with the corporate legal departments of the partnership.
- Providing support to the construction team, including, in respect of property and permit matters, building codes, and rail safety regulations.
- Ensure health & safety conformity with provincial regulations across active project sites.
- Liaise with external counsel on complex insurance claims and high-value litigation.
- Conduct internal training for project managers regarding contract compliance and risk mitigation.
Qualifications
- Juris Doctor (J.D.), Bachelor of Laws (LL.B.), and/or Master of Laws (LLM) from a recognized institution.
- Law Society of Ontario (LSO) membership in good standing.
- 3 to 5 years of post-call experience in construction law or major infrastructure projects.
- Familiarity with Progressive Design-Build delivery models in Ontario.
- Familiarity with key differences between various Construction Delivery Models.
- Familiarity with key terms and conditions in Construction Contracts.
- Familiarity with Construction Insurance, Surety Bonding, and Letters of Credit.
- Strong drafting skills specializing in customized construction agreements and supplementary conditions.
- Commercial acumen to quickly identify operational, financial, and interface risk.
- Problem-solving mindset to deliver pragmatic, business-oriented legal solutions.
- Clear written and oral communication skills.
